Adelaide Airport – Wi-Fi Terms and Conditions

This is a free wireless internet service ("Service") provided by Adelaide Airport Limited ("AAL") for your use while you are at the Adelaide Airport terminal ("Terminal"). By accessing the Service, you accept these terms and conditions as set out below ("Terms").

AAL may change these Terms at any time. You should review these Terms each time you access the Service.

Access to the Service 

1. You are responsible for providing your own wireless enabled device capable of accessing the Service with its own power source. AAL is not obliged to provide power, advice or assistance to any user of the Service. 

2. The Service is provided on an “as is” and “as available” basis. No warranty or representation is given in relation to the accessibility, security, stability, quality or reliability of the Service.

3. The Service is not suitable for supporting any application or use which requires secure, continuous, fault-free connectivity or uninterrupted data traffic flow.

4. AAL has no obligation to resolve any faults, malfunctions or problems associated with the Service.

5. You assume all responsibility and risk associated with using the Service. You are responsible for backing up your device and data. AAL is not liable for any loss or corruption of your data.

6. You must comply with all directions from AAL relating to your use of the Service.

7. AAL may alter, suspend, terminate or limit your use and/or access to the Service at any time in its sole discretion and without notice.

8. Without limiting clause 7 above, AAL reserves the right to limit or block your access to the Service if you are suspected or deemed to be in breach of these Terms or behaving in an inappropriate manner.

Prohibited Use 

9. You must not use or attempt to use the Service:

  1. in a manner that may adversely affect AAL's brand or reputation;
  2. in a manner that may damage, disable, overburden, disrupt or interfere with the operation, integrity or performance of the Service, or any of AAL's other networks, equipment or property;
  3. for unlawful, fraudulent or malicious purposes;
  4. to access, send, publish, promote or solicit material or content that is abusive, sexist, racist, unlawful, obscene, defamatory, libellous, harassing, menacing, threatening, pornographic, offensive, violent, sexually suggestive or discriminatory in nature or which could cause offence or harm;
  5. to make inappropriate contact with children or minors;
  6. in a manner that infringes any copyright, patent, trade mark, design or other intellectual property rights or confidential information;
  7. to access, monitor, use or control any device, account, equipment, network or data belonging to a third party or unauthorised monitoring of electronic communications;
  8. to originate, introduce or distribute any computer code or software (including but not limited to viruses, malware, trojans, keyboard loggers, worms or data harvesting software): (i) that is harmful, disabling or destructive; or (ii) which enables theft, denial of service, unauthorised access, disclosure, destruction or corruption of data;
  9. to send or transmit spam, unsolicited commercial messages or bulk emails; 
  10. in a manner that could cause AAL to breach any law or incur a liability to a third party.

Responsibility for Content

10. AAL may limit or block certain websites and/or content from being accessed while using the Service.

11. AAL does not exercise control over the content or material you access while using the Service and makes no warranty or representations regarding the compliance, accuracy, relevancy, fitness for purpose or quality of any material or content you access.

Security

12. The Service is provided on an open, public and unencrypted basis. You acknowledge that there are inherent risks in dealings over the internet.

13. AAL makes no warranties or representations regarding the security of the Service, your device or your data.

14. You acknowledge and agree that:

  1. there are risks associated with transmitting data, accessing websites and/or content using the Services;
  2. you are solely responsible for information, including personal information, or data uploaded, downloaded or communicated using the Service;
  3. it is your responsibility to take any security precautions to protect the security of your device and any transmissions made or received during your use of the Service, including but not limited to, encrypting confidential transmissions and backing up any data.

Supervision of Minors 

15. AAL is not responsible for supervising minors’ access to and use of the Service. Supervision and or restriction of a minor’s access and use of the Service is the responsibility of the minor’s parent or guardian.

Liability

16. You access and use the Service at your own risk.

17. To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied by statute, custom or the common law are excluded from these Terms.

18. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot be excluded, restricted or modified by agreement (Non-Excludable Guarantee). However, to the maximum extent permitted by law, AAL's liability for breach of a Non-Excludable Guarantee is limited, at our option, to:

  1. in the case of services, the cost of supplying the services again or payment of the cost of having the services supplied again; and 
  2. in the case of goods, the cost of replacing the goods, supplying equivalent goods or having the goods repaired, or payment of the cost of replacing the goods or of acquiring equivalent goods or having the goods repaired. 

19. To the extent permitted by law, AAL will not be liable for any direct, incidental, consequential, indirect, special or punitive losses or damage or inconvenience sustained, suffered or incurred by you or any person arising from or incidental to your access to or use of the Service regardless of the cause of action and whether or not it was foreseeable.

20. You agree to indemnify AAL and its personnel, subcontractors and agents from and against any loss, damage, costs (including reasonable legal and other professional costs on a full indemnity basis), liability or expense arising out of or in connection with:

  1. your access to, use or misuse of the Service; or
  2. a breach by you of these Terms.

Privacy Collection Statement

21. AAL collects your personal information when you access the Service. By accepting these terms, you agree to AAL collecting:

  1. information regarding your web browser, operating system and device type; 
  2. your name, email address, and general location information (such as your State of residence or postcode);
  3. location data at Adelaide Airport;
  4. URLs and the addresses of the websites you visit; and
  5. the IP and MAC address of any device that you use to access the Service. 

22. We may also collect your mobile phone number or other information about you, for example, your purposes for travel, where you provide it to us.

23. AAL collects the above information to ensure you access the Service in accordance with these Terms, as required or authorised by law and so that we can optimise how certain webpages are displayed on your device. If you do not provide AAL with this information, AAL will not be able to provide you with the Service.

24. Where you have consented to AAL doing so, AAL will use your personal information for marketing purposes.

25. AAL may disclose your personal information to third parties (such as our contractors who provide services to AAL and others as permitted or required by law). AAL will not usually disclose your personal information to recipients located overseas without your consent, except where required or permitted to do so by law.

26. AAL's privacy policy contains information about how you may seek access to, or correction of, personal information that AAL holds about you, how you may complain about a breach of the Australian Privacy Principles by AAL and how AAL will deal with such a complaint. 27. AAL is not responsible for the collection, storage, disclosure or use of your personal information by any third party not engaged by AAL (for example, any website you access while using the Service). You are responsible for checking any terms of use or privacy policy of a website that you visit and determining whether you accept such terms and privacy policies.

General

28. A waiver of any part of these Terms will only be effective if signed in writing by AAL. A waiver on one occasion, does not mean that those rights will automatically be waived on any other occasion.

29. If any part of these Terms is held to be invalid, unenforceable or illegal for any reason, that part must be read down to the extent necessary to preserve its operation. If it cannot be read down, it must be severed.

30. These Terms are governed by the laws of the State of South Australia and you submit to the non-exclusive jurisdiction of the Courts of that jurisdiction.
